You got this wrong: its ok to advertise to me, its not ok to use me to advertise.

You can't use Tom Cruise or Nicole Kidman to advertise your business without their permission (and huge $$$'s)

You are NOT the customer; the advertising industry is.
The simplest solution would be not to "+1" any pages, products and completely ignore google social network.

then the checkbox next to the setting "Based upon my activity, Google may show my name and profile photo in shared endorsements that appear in ads." is in fact not checked. I.e. I'm seeing it as opt-in (not as opt-out).
Anyone seeing a different default setting with their account?

As +Seth Godin says – Google are having their jump the shark moment

However, the actual update to the ToS is a good improvement by Google because users didn't get a choice about that before – so now they are improving (which means providing an option to limit) how Google use your photo/name/.. in other commercial contexts.

It won't happen but if every Google user updated their shared endorsements settings to limit Google's use, this would actually be a negative for Google.
